Informed consent is defined by the California Penal Code (section 261.1) as "positive cooperation in act or attitude pursuant to an exercise of free will. The person must act freely and voluntarily and have knowledge of the nature of the act or transaction involved."

Today, the emphasis is on informed sexual consent. The concept of "informed consent" was developed by the health/medical industry as a way to protect themselves against "malpractice" lawsuits.

It is also another example of the "nanny state", where "ethics committees are in charge of ensuring that everything is always fully and completely "ethical".
